Terms of use of the QTable platform

These general terms govern the use of the QTable online reservation and table management platform (hereinafter: the Service). By registering or using the Service, you agree to these terms. Please read them carefully.

1. Parties and applicability

QTable provides the Service. You are the business or legal entity that creates an account and uses the Service for your own business purposes. Your own terms apply only if QTable accepts them in writing.

2. Service and account

QTable provides you with an environment on a subdomain of your choice, including the features included in your selected plan at registration. You are responsible for the accuracy of the information provided at registration and for keeping your login credentials confidential.

QTable may maintain, improve or temporarily suspend the Service. Where possible, maintenance will be announced in advance. QTable aims for high availability but does not guarantee uninterrupted operation.

3. Subscriptions and payment

The selected plan and applicable prices are stated at registration or on the website. Billing and payment terms follow from the quote, order confirmation or invoicing process applicable to your agreement.

In case of non-payment or default, QTable may suspend or terminate access to the Service, after prior notice of default where required by law.

4. Use of the Service

You agree to use the Service:

QTable may apply reasonable usage and technical limits to prevent abuse. In case of serious or repeated breach, QTable may block the account or terminate the agreement.

5. Data and privacy

The processing of personal data is described in our privacy policy. That privacy policy forms an integral part of your relationship with QTable regarding data protection.

6. Intellectual property

All rights in software, design, trademarks and other QTable materials belong to QTable or its licensors. You receive only a non-exclusive, non-transferable right to use the Service within the scope of your subscription.

Data and content you enter into the Service (e.g. reservations and business data) remain yours or your organisation’s, to the extent you hold the rights. You grant QTable the right to process and store that data only as necessary to provide the Service.

7. Liability

QTable is not liable for indirect damage, consequential loss, lost profits or data loss, except where mandatory law provides otherwise. QTable’s total liability to you per event (or series of related events) is limited to the amount you paid to QTable for the Service in the twelve months preceding the event, unless there is intent or gross negligence on the part of QTable.

8. Term and termination

The agreement runs for the term of your subscription or trial period, under the terms applicable at the start. Either party may terminate the agreement subject to the notice period and terms in your specific agreement or general invoicing terms.

After termination, QTable may delete or archive your data in accordance with the privacy policy and statutory retention periods.

9. Changes

QTable may change these general terms. The current version is always on this page. We will inform you of material changes by email or via the platform where reasonable. If you continue to use the Service after the change takes effect, you are deemed to accept the new terms, to the extent permitted by law.

10. Applicable law and disputes

These terms are governed by Belgian law, insofar as mandatory consumer law does not provide otherwise. Disputes are preferably resolved amicably. If that fails, the courts with jurisdiction at QTable’s place of establishment have jurisdiction, unless the law requires a different forum.
